Corporate Restructuring and Insolvency – Our Firm’s Services

Polish restructuring and insolvency law provides tools to protect assets and jobs and to limit the personal liability of management. Our firm supports both debtors and creditors—from filing the petition, through the conduct of proceedings, to final settlements.

Petitions to Open Restructuring Proceedings (UK, PR, PN)

We prepare and file petitions to open restructuring proceedings: arrangement proceedings (UK), accelerated arrangement proceedings (PR), and proceedings for approval of an arrangement (PN). We handle all formalities and ensure the court receives a complete set of required documents.

Representation of Creditors on Creditors’ Committees and in Arrangement Voting

We represent creditors throughout the proceedings, including matters relating to participation on creditors’ committees and voting on the arrangement.

Protecting Management from Liability for Failure to File on Time

We advise management board members on how to mitigate the risk of personal liability. We prepare opinions and recommendations regarding the timely filing of petitions.

Pre-Packaged Liquidation (“Pre-pack”) and Sale of an OCE

We conduct pre-packaged liquidation proceedings (“pre-pack”) enabling the swift sale of an enterprise or an organised part of an enterprise (OCE).

Filing Claims and Supervising Bankruptcy Proceedings

We assist creditors with filing claims and monitor the course of bankruptcy proceedings. We also support creditors in obtaining information from the bankruptcy trustee.

Negotiations with Banks and Financing Institutions (Standstill, “Haircut”)

We conduct negotiations with financing institutions regarding standstill arrangements and debt reduction (“haircut”).

Tax Planning and Analysis of Managerial Liability Risk

We advise on the tax implications of restructuring and insolvency measures and analyse the risk of management liability in connection with the company’s financial position.
